Ownership of Data
All rights in Data remain vested in the Customer.
The Customer gives SSA a right to process Data.
What can SSA do with Data?
SSA, and its Related Bodies Corporate, including Agriculture Victoria Services Pty Ltd, may:
(a) create Derivative Materials, including by;
i. compiling,
ii. combining with other information,
iii. conducting data analytics,
iv. developing and manipulating the Data.
(b) use and disclose Derivative Materials provided it does not disclose Derivative Materials which incorporate any Personal Information without Customer’s prior consent;
(c) use information about the Customer and their use of the Web application, for the purposes of;
i. billing,
ii. capacity planning,
iii. compliance,
iv. improving the Web application,
v. detecting and addressing threats to the functionality, security, integrity and availability of the Web application,
vi. detecting and addressing breaches of the Agreement, SSA policies
vii. to resolve Customer’s service requests.
(d) use any non-Personal Information of the Customer for the purpose of enhancing and improving the Web application offered by SSA.
Data means any data uploaded to, or processed through, the Web application, or otherwise provided to SSA, by the Customer and includes the Farm Data.
Derivative Materials means materials, data, insights, works or other things derived or created by or on behalf of SSA from or by reference (wholly or partly) to the Data.
Farm Data means any data relating to the operations, conditions or other characteristics of a farm, that is:
- produced by the Customer or their staff/ contractors/equipment; or
- created/packaged/acquired at the request of the farmer (i.e. farmer permissioned its collection) and/or in the provision of a service, and is specific to their farm;
- or produced on the farm.
